§1 Course participants and tenants
Anyone who is neither physically nor physically impaired in order to be able to practice kite sport or SUP sport without endangering themselves or others is entitled to participate and rent. The prerequisite for participating in a kite course, kite rental or SUP course, SUP rental is the ability to swim for at least 15 minutes in the open water without aids. In the case of minors, the consent of the legal representative is required.

§2 Registration / withdrawal from the contract
Registration for a kite course must be in writing (email). The same applies to the conclusion of the course or rental contract in the form of a course voucher, which is also an invoice. In the case of minors, the written consent of the legal representative must be provided. A withdrawal from the contract must be declared in writing. If the withdrawal takes place after the fixed booking and dispatch of the respective course voucher or invoice, 50% of the respective course price or the converted amount of the remaining hours will be retained if no replacement participant / lessee is provided. We reserve the right to withdraw from the contract without observing a deadline if the minimum number of participants for the respective course announcement according to the internet in the kite courses is not reached. The same applies in the event of force majeure (strong winds, lightning strikes, temperatures below 10 ° C), destruction of the kitesurfing material due to collisions or vandalism and sudden immobility. Payments made will not be reimbursed if a comparable alternative offer can be made, booked, unused hours remain valid for up to 1 year after the invoice date. Participants who permanently disrupt a course, behave improperly – both on site and via the Internet – or who deliberately endanger themselves and others can be excluded from further participation. Payments made will not be refunded to them. There are no further claims.

§3 Obligation to cooperate
In the event of any disruptions in performance, the participant is obliged to do everything reasonable to help remedy the disruption and to keep any damage that may have occurred as low as possible.

§4 Security / Implementation Conditions
The instructor’s instructions must be followed. For all kite courses, glasses must be secured against loss and jewelry such as rings removed. Changes in the course of the course due to weather conditions cannot always be ruled out. If it is not possible to carry out the course in the agreed period, a new course date will be agreed.

§5 due diligence
The safety and operational readiness of the kite material is ensured by regular inspections. Nevertheless, the participant / renter is obliged to check the kite material before starting the journey. In the interests of all parties involved, each participant / tenant is obliged to report any damage immediately. If the operational readiness of the kite material is no longer guaranteed due to non-compliance with the instructions of the instructor or due to negligent or even deliberate behavior on the part of the participant / tenant, the participant / tenant is not entitled to compensation for the time lost due to the assessment and troubleshooting.

§6 liability
We are liable for the conscientious preparation of the course and event, the careful selection and monitoring of the service providers, the correctness of the course description and the proper provision of the contractually agreed service, as well as for the conscientious performance of the inspection to ensure the operational readiness of the kite material. Liability for property damage and personal injury is excluded! In the event of damage caused by themselves or by third parties, the participant / tenant has an obligation to notify. The participant / tenant is personally liable for self-inflicted damage (including failure and consequential damage) to the material and equipment. No liability is assumed for the loss of valuables, glasses, jewelry, money and other items.

§7 Additional course conditions
There is hardly any other water sport that demands flexibility and mobility as much as kitesurfing. Change of location for the best learning conditions is a standard. NorthWest Kiteboarding offers this flexibility and mobility and ensures a smooth organizational process and material transport. Approaches to the alternative spots and additional time expenditures must be made by the participant.

§8 Additional rental conditions
NorthWest Kiteboarding is entitled to refuse to hand over the kite equipment if the renter does not have the required qualifications (min. VDWS license level 5, Watersportverbond module 6, IKO level 3). The tenant is obliged to return it on time. Meteorological events are to be taken into account and do not constitute a reason for late return. In addition, the tenant is jointly and severally liable to the landlord for all obligations arising from the rental agreement. The tenant is also responsible for any negligence on the part of his co-users.

§9 Severability Clause
The ineffectiveness of individual provisions does not result in the ineffectiveness of the contract. The contracting parties undertake to replace any invalid provision, if possible, with a clause corresponding to the presumed will.
